Help with serious tax problems in the Capital District
Koff Tax Advocates assists and represents you in all major tax legal situations, including the following:
Offers in compromise
If you have a significant amount of unpaid tax that you cannot afford to pay in full, you may pursue an offer in compromise. Under this process, the IRS may accept less than 100 percent of what you owe. Qualifying for an offer in compromise can be difficult. You need the guidance of an experienced tax attorney when filing for this concession. Koff Tax Advocates has a team of tax professionals who utilize their experience and best efforts to help you secure an accepted offer in compromise.
Installment payment agreements
When you owe back taxes, you may qualify for a payment plan if you can afford to make monthly payments. The IRS (and New York State) determines your payment schedule based on the amount you owe and what you can reasonably afford to pay. Koff Tax Advocates helps you present your financial circumstance accurately so you may secure your installment payment agreement, including reasonable terms.
Partial payment installment agreement
You may qualify for a partial payment installment agreement (PPIA). Under a PPIA, you "settle" your tax liability with the IRS for less than the full amount of your liability. The IRS reviews your financial information, and seeks equity in your assets that may be used to reduce your outstanding tax liability. Your financial circumstance is reviewed every two years, and your payments may be adjusted accordingly. The IRS prefers that you make payments to your PPIA by direct debit from your bank account. Koff Tax Advocates has the experience to help you get your application for a partial payment installment agreement approved.
Currently not collectible status (CNC)
You may be able to receive currently not collectible status (CNC), also known as uncollectible status, for your unpaid tax. This status requires you to prove your inability to pay your back taxes. You must demonstrate a legitimate financial hardship, such as the following:
- Inability to meet your basic living expenses
- Personal bankruptcy
- Loss of your home
- Failure of your personal business
Your assertion of hardship must be demonstrated through full disclosure of your financial situation. If your request is approved, the IRS will not seek to collect for you for at least one year. Koff Tax Advocates helps you prepare your request to optimize your chance of approval for CNC status.
Release of levies
Revenue officers may pursue past-due tax amounts by placing levies on your bank account and your wages. With or without warning, you may find the following:
- Your bank account is frozen and you have no access to your funds
- Your wages are garnished and you do not receive your full pay
- IRS may garnish nearly 100 percent of your wages!
Releasing your funds from a bank levy or wage levy requires significant knowledge of tax law strategy. Koff Tax Advocates handles the complex negotiation required to remove levies from your assets.
Audits
You should always respond to a notice of an audit, and you should always bring a lawyer with you to the auditor's office. Koff Tax Advocates represents individuals and businesses in all types of tax audits.
